Description

Job Purpose           

Personally manages Medicaid and VA client caseload, guiding clients through the planning and application process to make obtaining benefits as efficient and problem-fee as possible.

Provide legal support to Nugen Law attorneys in all matters pertaining to Elder Law, Estate Planning, Estate Administration.

Duties and Responsibilities

  • Review new public benefit cases (Medicaid/Veterans Administration) as they come in.
  • Meet with attorney managing public benefits cases, elder care coordinator assigned to the case, and clients on strategy and implement the plan designed by the Attorney managing the case for the client – delegate to client as client may tolerate.
  • Obtain information needed for Medicaid/VA application, e.g., research assets, income information, determine whether spend down requirements have been met.
  • Prepare paperwork to sell or transfer assets, including beneficiary designations, pay on death, transfer on death, deeds, etc.
  • Research bank accounts, health insurance premiums, stock valuations, property valuations, etc. and assist clients in gathering documents.
  • Process resource assessments.
  • Follow up with Medicaid office to ensure all paperwork is received, answer questions from Caseworkers, comply with requests and negotiate with Medicaid office as needed.
  • Represent clients at Initial Hearings and Fair Hearings.
  • Interface with nursing homes regarding the status of the Medicaid application.
  • Redeterminations as needed for clients that have renewed.
  • Handle any Medicaid-related issues for Medicaid beneficiaries, billing issues, unexpected Medicaid terminations and client questions as they arise.
  • Obtain information needed for VA applications; complete same; and follow up on status.
  • Prepare, edit, print and execute documents including Wills, Trusts, Powers of Attorney and Health Care Representative Designations.
  • Assist with the funding of client estate plans and trusts including asset transfers and liquidation of existing accounts.
  • Execute estate plans with clients, including travel to nursing homes and/or private homes of clients if necessary.
  • Estate Administration duties, including Probate, preparation and filing of pleadings, inventory and preparation of Accounting and Estate Settlements.
  • Communicate with clients, financial institutions, and other professionals.
  • Draft letters and invoices.
  • Enter all client info into system for document preparation.


Requirements

  • College degree preferred
  • Paralegal degree preferred but not required. Experience can be substituted.
  • Five (5) years Medicaid application process, estate planning, estate administration and elder law experience
  • Knowledge of Medicaid asset protection and process of application for Medicaid benefits
  • Knowledge of estate planning, deeds, trusts, and financial tools.
  • Excellent business writing and math skills.
  • Exceptional client communication skills, a desire to help others, and comfortable working with older people, people with disabilities, their families and other professionals.
  • Able to work a regular full-time weekly schedule from 8:00 a.m. to 5:00 p.m., with one hour for lunch. Able to work longer depending on deadlines.
  • Present a professional appearance and demeanor.
  • Quick and adaptable learner.
  • Excellent problem-solving skills and ability to apply common sense.
  • Willing to research, learn, and follow rules and policies.
  • Perform duties while maintaining the highest standard of confidentiality.
  • Possess a valid driver’s license and reliable vehicle as travel is required to clients’ homes, long-term care facilities, financial institutions and Medicaid offices.
  • Able to maintain composure, possess a high frustration/tolerance level, and display patience and kindness towards clients and agency contacts.
  • Skilled in the use of Microsoft Office, with emphasis on Word and Excel.
  • Knowledge of ElderCounsel and Clio preferred but not required.
  • Highly refined skills in critical thinking, written and verbal communication, organization, attention to detail, and information monitoring.
  • Indiana Notary preferred but not required.

Working Conditions

Office Setting – infrequent travel required.

Physical Requirements

Ability to sit for extended periods of time, climb stairs and easily ambulate.
